When an employee in Portugal works overtime on a weekly rest day or public holiday, they are entitled not only to a payment with premium but also to compensatory rest — a day off to recover the lost rest. This is governed by Article 229 of the Portuguese Labour Code, and it is a cumulative right, not an alternative. Forgetting to grant compensatory rest in addition to the overtime payment is a common mistake generating labour liability over time.
This guide explains the complete regime of compensatory rest for international employers in Portugal: when it applies, how it is calculated, the deadlines to grant it, interaction with payroll, and specific cases that cause confusion.
When compensatory rest applies
Compensatory rest (descanso compensatório) is mandatory when overtime is worked on:
- Weekly rest day (obligatory or complementary, per Article 232)
- Public holiday — national, regional or municipal
Overtime on normal weekdays triggers only the premium payment (Article 268) — not compensatory rest. The compensatory rest regime is specifically about restoring lost rest days.
How it is calculated
The right is to a full day off in a working day within the 3 working days following the day on which the overtime was worked (Article 229, paragraph 3). The compensation is proportional to the day’s work, not to the specific hours worked. Working any portion of a weekly rest day generates right to the compensatory day.
If the compensatory rest cannot be granted within 3 working days — for example because the employee is on vacation or the operation does not allow it — the employee may be paid for the day in money, as additional overtime (Article 229, paragraph 4).
Interaction with overtime payment
Overtime on weekly rest day or holiday is paid with specific premium rates (Article 268):
- Weekly rest day (obligatory): base pay + 50% premium
- Public holiday: base pay + 100% premium (in addition to the holiday pay itself)
Both the premium AND the compensatory rest are due. The compensation is cumulative, not alternative. This is the single most common error — paying the premium and forgetting the rest day, or vice versa. In labour litigation, both are claimed with 5 years of back retroactivity.
Practical examples
Employee works Sunday to help with inventory
Sunday is the weekly rest day. The 8 hours of work generate: (a) base pay for the day + 50% premium = 1.5× daily pay, and (b) one compensatory rest day in the following working week.
Employee works 25 December (Christmas, public holiday)
The 8 hours generate: (a) regular monthly salary already includes paid holiday, so no base pay added; (b) 100% premium on the hours worked = double daily pay; (c) one compensatory rest day in the following 3 working days.
Employee works 4 hours on Saturday (weekly rest day) at employer’s request
Half-day work still generates right to a full compensatory day. The partial day worked generates the premium pay on actual hours.
Compensatory rest coincides with vacation
Vacation already has specific protection. The compensatory day should be scheduled outside the vacation period. If no working day is available in the following 3 days, pay in money.
Employee self-schedules weekend work without authorization
If overtime is not authorized by the employer, it may not generate right to premium or compensatory rest — but this gets contentious in disputes. Best practice: all overtime requires written authorization in advance; otherwise it is deemed not worked at employer’s request.
Registration and payroll integration
Attendance software should:
- Mark the day worked as “weekly rest day worked” or “holiday worked”
- Automatically calculate the applicable premium per Article 268
- Create a compensatory rest entitlement in the employee’s balance
- Suggest or schedule the compensatory day within 3 working days
- Flag if the compensatory rest cannot be granted and conversion to monetary payment is required
- Produce reports showing both premium payments and compensatory rest grants per employee
Manual tracking in Excel is the main source of liability — employers forget to track one of the two components. Automated tracking eliminates this error.
Specific regime for shift workers
Shift workers (Articles 220-224) with rotating weekly rest schedules have the same right to compensatory rest when working on their individual rest day. The compensatory day should fall on another day in the normal rotation, not necessarily matching standard weekdays.
Dispute scenarios
In labour disputes concerning overtime, the following are commonly claimed by employees retroactively (up to 5 years):
- Unpaid overtime hours worked
- Unpaid premium rates on overtime
- Unpaid night premium on nocturnal overtime
- Un-granted compensatory rest days (converted to monetary value)
- Un-paid vacation and Christmas subsidies on overtime
Robust time registration + automated calculation eliminates all five claims. The investment in proper software is routinely paid back by avoided litigation within 12 months.
Compliance checklist
- Written policy requiring prior authorization for all overtime
- Attendance system distinguishes normal day / rest day / holiday work
- Overtime premium calculated automatically per Article 268
- Compensatory rest entitlement recorded automatically
- Compensatory day scheduled within 3 working days of overtime
- Monetary conversion applied only when working day genuinely unavailable
- Payroll integration with both premium and compensatory tracking
- Monthly report on both unpaid balance of compensatory days and total overtime
- 5-year retention of all records

Conclusion
Compensatory rest is one of the most frequently overlooked rights in Portuguese labour management. The combination of monetary premium + rest day for overtime on rest days and holidays is cumulative, not alternative. Proper time registration software with automated premium and compensatory-day tracking eliminates this liability source and routinely pays back the investment within months in avoided litigation.
